11 月 21 日，中国检察官微信公众号刊文《刑事检察 | 非法窃取比特币的刑法定性》，其中指出认定非法窃取比特币行为性质，必须先解决比特币能否成为刑法意义上财产的问题，即比特币所附着的支配权益能否成为刑法所保护的法益。比特币的财产属性是根据国家不同时期的法秩序要求而不断变化的。当前，我国明确虚拟货币相关业务活动属于非法金融活动，而个人支配的比特币也不能认定为刑法意义上的财产。在比特币无法认定为财产的情况下，非法窃取比特币的行为，需用计算机信息系统犯罪予以规制。
