前提 电动车追尾自行车。自行车车主腰椎骨折共花费医药费 7 万余元。交警已经判了电动车主要责任。
想要赔偿金额是医药费的 70%（主要责任），电动车肇事人赔偿态度消极。（年龄 60 多岁，勉强算技术工种。工资 7000-8000 ）。
不清楚起诉法院后还不赔偿能否刑事拘留它。
