In a dramatic turn of events, the Moskowitz Law Firm, representing victims affected by the FTX collapse, has been struggling to serve a legal complaint against NBA legend Shaquille O’Neal. Despite their repeated unsuccessful attempts, the law firm has made a public plea, urging O’Neal to display “courtesy and honor” by acknowledging the legal complaint.

Week-long Efforts to Serve Shaquille O’Neal

On April 14, the Moskowitz Law Firm took to Twitter, disclosing that its team had been stationed outside the TNT studios in Atlanta for the entire week. Currently working as a television host at the studio, O’Neal endorsed the now-defunct FTX cryptocurrency exchange, leading to the law firm’s efforts to serve him on behalf of the affected FTX investors.

However, O’Neal’s security personnel denied the law firm access to deliver the legal complaint personally. Consequently, the Moskowitz Law Firm has been unable to serve O’Neal, who remains the only “FTX celebrity” yet to be served in the class-action lawsuit targeting several high-profile individuals for endorsing FTX, including Tom Brady, Steph Curry, and Larry David.

The law firm accused Shaquille O’Neal of evading them for three months and urged him to exhibit honor by allowing their process servers to deliver the legal complaint. That would enable him to defend his actions in the matter.

An April 7 court filing highlighted the numerous attempts to serve O’Neal in different locations, all proving fruitless. The filing stated, “Mr. O’Neal is the remaining defendant who has not been served. Despite Plaintiffs’ dozens of attempts in multiple states and countries, to either effect service on him or have him (or a designated agent) accept service of process.”

Intimidation Tactics and Alternative Methods

According to the court filing, a process server in Texas, Mr. Shaw, received a threatening message following his “eighth most recent attempt” to serve O’Neal at his Texas residence. The message mentioned Shaw’s wife, Beth Shaw, and suggested that Shaq lived in the Bahamas, using derogatory language.

Plaintiffs now believe it is “finally time” to explore alternative means of contacting O’Neal, such as sending direct messages to his verified social media accounts.

On March 9, it was reported that United States District Judge Kevin Moore was contemplating dismissing Shaquille O’Neal and tennis athlete Naomi Osaka from the lawsuit. 

The judge pointed out the lack of clarity surrounding whether the two celebrities had been served. Consequently, Judge Moore issued a paperless order, giving FTX customers until December 2023 to justify including both stars in the lawsuit.

As the Moskowitz Law Firm continues its pursuit to serve Shaquille O’Neal with the legal complaint, the case has gained significant attention. However, it remains to be seen how the legal proceedings will unfold and whether the NBA superstar will finally acknowledge the complaint.
