近日，重庆市万州区文化和旅游发展委员会依法对重庆某网络科技有限公司擅自出版网络游戏的违法行为作出
没收违法所得人民币4.9万元、罚款人民币39.2万元的行政处罚。
经查，2018年5月至案发期间， 该公司在未取得游戏出版物版号和审批文号等相关资质的情况下，利用多个网络直播平台向用户推广并运营某网络游戏 ，其中部分下载用户涉及未成年人。
运营期间，该公司以平台代理的方式进行充值牟利。
根据《网络出版服务管理规定》第二十七条：网络游戏上网出版前，必须向所在地省、自治区、直辖市出版行政主管部门提出申请，经审核同意后，报国家新闻出版广电总局审批。
