1978 年前，美国的著作权保护期最长为出版后 56 年—— 28 年加 28 年，后 28 年由作者续展，而统计显示 85% 的作者放弃再延长 28 年。但在 1998 年美国国会通过了新的版权保护法，增加了 20 年的著作权保护期限，将保护期限延长至作者死后 70 年或作品出版后 95 年。随着 2021 年 1 月 1 日的到来，1925 年出版的美国作品进入了公有领域，其中的知名作品包括了菲茨杰拉德（F. Scott Fitzgerald ）的《了不起的盖茨比》 ，伍尔夫(Virginia Woolf)的《达洛维夫人》，海明威（Ernest Hemingway）的短篇小说集《In Our Time》，卡夫卡（Franz Kafka）的《审判》，此外还有许多默片和音乐作品。
